Adoption Statement

 

Notification under Regulations 26 and 35 of the Town and Country Planning (Local Planning) (England) Regulations 2012 (as amended)

 

Planning and Compulsory Purchase Act 2004 (as amended)

 

 

In accordance with the above Regulations, notice is hereby given that the Minerals & Waste Joint Plan 2015–2030 and accompanying Policies Map was formally adopted by the City of York Council on [date month 2022]. For the City of York Council there are no adopted Plans which the Minerals & Waste Joint Plan will replace. However, the City of York Draft Local Plan (incorporating the Fourth Set of Changes), April 2005 was approved for development management purposes (some of the policies refer to minerals & waste). The City of York 2018 Publication Draft Plan contains policies which refer the decision maker to the Minerals and Waste Joint Plan.

 

The Minerals & Waste Joint Plan 2015 – 2030 was the subject of an independent examination conducted by Elizabeth C Ord (LLB(hons) LLM MA DipTUS), an Inspector appointed by the Secretary of State. The examination included public hearing sessions between 27 February 2018 and 25 January 2019. The Inspector’s Report was issued on date 4th February 2022 and concluded that the Minerals and Waste Joint Plan is sound and legally compliant, subject to the Inspector’s Main Modifications pursuant to Section 20(5) of the Planning and Compulsory Purchase Act 2004.

 

The adopted Minerals & Waste Joint Plan 2015–2030 (month 2022) incorporates all the Main Modifications set out in the appendix to the Inspector’s Report, as well as the Authority’s Additional Minor Modifications to the Submission Plan.

 

The adopted Minerals & Waste Joint Plan 2015–2030, Policies Map, Sustainability Appraisal Report and Adoption Statement can be viewed on the Authority’s website at:

The Minerals and Waste Joint Plan 2015-2030 and accompanying documents can be viewed at the Authority’s Offices at West Offices, Station Rise, York, YO1 6GA by appointment only. Copies will also be placed in local libraries (subject to any restrictions that may be in place).

 

Any person aggrieved by the adoption of the Minerals and Waste Joint Plan 2015-2030 may make an application to the High Court, under Section 113 of the Planning and Compulsory Purchase Act 2004, on the grounds that (i) the Plan is not within the appropriate power of the local planning authority and/or (ii) a procedural requirement has not been complied with. Any application must be made no later than the end of the period of six weeks starting from the date the Joint Plan was adopted. This period ends on [date month 2022].
